Worker Illegally Fired in Retaliation for Critical Tweet, US Labor Board Finds


The National Labor Relations​ Board alleges that X’s firing of an employee who opposed Elon Musk’s return-to-office ⁢policy last year was illegal. According to Bloomberg, this ‍is ‍the NLRB’s first formal complaint against X Corp. The‍ labor board accuses the company of retaliating against software engineer Yao Yue for trying ⁢to ‌organize workers in response to the new policy. When ​Musk ⁢gave an ultimatum to ⁣then-Twitter employees in November ⁣2022 to return to the office, Yue encouraged others not to resign but to let Musk fire them instead.

At the time, Musk ⁢stated, “If you⁢ can physically make it‌ to an office and you don’t show up, resignation accepted.” Yue was fired five⁤ days after tweeting about ⁢it and posting a similar message on Slack. The ‌complaint, filed ⁢by a ‍San Francisco branch of​ the NLRB, claims that the company violated federal labor law by “interfering with, restraining, and coercing employees” when terminating Yue.
