The lawsuit alleges that ‌Dunkin’ charges more for plant-based or lactose-free milk than‍ for cow’s milk, which the plaintiffs argue is discriminatory under ⁢the Americans with ⁢Disabilities Act ⁤(ADA). The ADA, which became law in 1990, aims to provide equal access to places of⁤ business for disabled‌ people. The lawsuit claims that lactose ​intolerance is a disability and seeks⁤ damages from Dunkin’. Some argue that⁤ this does not violate the ​ADA, as many⁢ people choose plant-based drinks for reasons other than⁣ lactose intolerance. However, an ⁢analyst at the ‌Good Food Institute states that plant-based milk prices were ​87%‌ higher‌ than conventional milk in 2022.
