X, the social media company previously known as Twitter, is taking legal action against the state of California regarding a law that mandates companies to disclose information about their content moderation practices. The law, called AB 587, necessitates social media companies to publicly share details about how they handle hate speech, extremism, misinformation, and other related matters, as well as specifics about their internal moderation processes.
Attorneys representing X argue that the law is unconstitutional and will result in censorship. In the lawsuit, the company stated, “It is the purpose and probable effect of AB 587 to exert pressure on companies like X Corp. to remove, demonetize, or give lower priority to speech that is protected by the Constitution. The true intention of AB 587 is to compel social media platforms to ‘eliminate’ certain constitutionally-protected content that the State deems problematic.”
